By accessing or using the services provided by Datamiind S.L. ("Datamiind", "we", "us", or "our"), including our website at datamiind.com and our Business Intelligence platform (collectively, the "Services"), you agree to be bound by these Terms of Service ("Terms"). If you are using the Services on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
If you do not agree to these Terms, do not access or use our Services.
Datamiind provides a cloud-based Business Intelligence and data analytics platform that enables organizations to connect data sources, build dashboards, run analytical queries, automate data pipelines, and share insights. The specific features available to you depend on your subscription plan.
To access most of our Services, you must register for an account. You agree to provide accurate, current, and complete information during registration and to keep your account information updated. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
You must notify us immediately at hello@datamiind.com if you suspect unauthorized access to your account. We are not liable for losses caused by unauthorized use of your account if you have failed to keep your credentials secure.
Datamiind offers subscription plans as described on our Pricing page. Prices are exclusive of applicable taxes (including Spanish IVA) unless stated otherwise. We reserve the right to modify pricing with 30 days' advance notice.
Subscriptions are billed in advance on a monthly or annual basis, depending on your selected billing cycle. Annual subscriptions are non-refundable except as described in Section 4.4. You authorize us to charge your payment method on a recurring basis until you cancel.
We may offer a free trial period. At the end of the trial, your account will automatically convert to a paid subscription unless you cancel before the trial period ends. No charge will be made during the trial period.
You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period — you will retain access until then. Monthly subscriptions are non-refundable for the current period. Annual subscriptions are eligible for a pro-rata refund within 14 days of purchase if you have not made substantial use of the Services. Refund requests after 14 days are evaluated on a case-by-case basis.

We reserve the right to suspend or terminate accounts that violate this Acceptable Use policy, with or without prior notice.
Your use of the Services is governed by our Privacy Policy. When you process your organization's data through the platform, Datamiind acts as a data processor on your behalf. A Data Processing Agreement (DPA) governing this relationship is available on request at hello@datamiind.com.
You retain ownership of all data you upload to the platform. We will not use your data for any purpose other than providing the Services to you, except as required by law or as described in our Privacy Policy.
The Datamiind platform, including all software, algorithms, interfaces, documentation, and content created by us, is owned by Datamiind S.L. and is protected by intellectual property laws. These Terms grant you a limited, non-exclusive, non-transferable license to use the Services during your subscription term, solely for your internal business purposes.
You may not copy, modify, distribute, sell, or create derivative works based on our platform or content without our prior written permission.
We target 99.95% monthly uptime for our platform. Scheduled maintenance windows are announced with at least 48 hours' notice where possible and are excluded from uptime calculations. We are not liable for downtime caused by third-party services, internet connectivity issues outside our control, or force majeure events.
To the maximum extent permitted by applicable law, Datamiind's total liability to you for any claims arising out of or related to these Terms or the Services shall not exceed the amounts you paid to Datamiind in the twelve months preceding the event giving rise to the claim.
In no event shall Datamiind be liable for indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, even if we have been advised of the possibility of such damages.
You agree to indemnify, defend, and hold harmless Datamiind and its officers, directors, employees, and agents from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising from: (a) your use of the Services in violation of these Terms; (b) your violation of any law or third-party rights; or (c) the data you upload or process through the platform.
These Terms are governed by the laws of Spain. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Barcelona, Spain. If you are a consumer in the EU, you may also use the European Commission's Online Dispute Resolution platform at ec.europa.eu/odr.
We may update these Terms from time to time. Material changes will be communicated by email or prominent notice on the platform at least 30 days before taking effect. Your continued use of the Services after the effective date constitutes acceptance of the updated Terms.
