Datamiind S.L. ("Datamiind", "we", "us", or "our") is committed to protecting the personal data of our users, customers, and website visitors. This Privacy Policy explains how we collect, use, store, and share your personal data when you use our website at datamiind.com and our Business Intelligence platform services (collectively, the "Services").

We are registered in Spain and operate in accordance with Regulation (EU) 2016/679 (the General Data Protection Regulation, "GDPR") and Spanish data protection law (Ley Orgánica 3/2018, LOPDGDD).

3.1 Information You Provide Directly

  • Account registration: name, email address, company name, job title, and password.
  • Contact forms: name, email address, company, and message content.
  • Billing information: name, billing address, and payment card details (processed via our payment processor; we do not store full card numbers).
  • Support requests: communication content when you contact our support team.

3.2 Information Collected Automatically

  • Usage data: pages visited, features accessed, session duration, click paths, and error logs.
  • Technical data: IP address, browser type and version, operating system, device type, and referring URL.

3.3 Customer Data

When you use the Datamiind platform to connect and analyze your organization's data, we process that data solely on your behalf as a data processor. Our use of your customer data is governed by our Data Processing Agreement (DPA), available on request.

We do not sell your personal data. We share data only in the following circumstances:

  • Service providers: third-party vendors who help us operate our services (cloud infrastructure, payment processors, email delivery, customer support tools) under strict data processing agreements.
  • Legal compliance: when required by applicable law, court order, or regulatory authority.
  • Business transfers: in connection with a merger, acquisition, or sale of assets, with notice to you where required by law.
  • With your consent: any other sharing with your explicit prior consent.

6. International Data Transfers

Our infrastructure is hosted within the European Economic Area (EEA). Where we transfer data outside the EEA, we rely on Standard Contractual Clauses (SCCs) approved by the European Commission or other transfer mechanisms permitted under GDPR.

7. Data Retention

We retain personal data for as long as necessary to fulfil the purposes described in this policy, unless a longer retention period is required by law:

  • Account data: retained for the duration of your account plus 3 years after closure.
  • Billing records: 7 years (Spanish tax law requirement).
  • Support communications: 2 years from resolution.
  • Marketing opt-in records: until consent is withdrawn.
  • Website analytics: 26 months in aggregate form.

8. Your Rights Under GDPR

As a data subject in the EU/EEA, you have the following rights regarding your personal data:

  • Access: request a copy of the personal data we hold about you.
  • Rectification: correct inaccurate or incomplete data.
  • Erasure: request deletion of your data where there is no legitimate reason to retain it.
  • Restriction: request we restrict processing of your data in certain circumstances.
  • Portability: receive your data in a structured, machine-readable format.
  • Objection: object to processing based on legitimate interests or for direct marketing.
  • Withdraw consent: withdraw consent at any time where processing is consent-based.

We implement appropriate technical and organizational security measures to protect your personal data against unauthorized access, accidental loss, destruction, or alteration. These measures include encryption in transit (TLS), encryption at rest, access controls, SOC 2 Type II certification, and regular security audits. However, no internet transmission is completely secure, and we cannot guarantee absolute security.

10. Children's Privacy

Our Services are not directed at children under the age of 16. We do not knowingly collect personal data from children. If you believe we have inadvertently collected data from a child, please contact us immediately so we can delete it.
